Affiliate Program Terms & Conditions

These terms and conditions (“Terms”) govern the participation of affiliates (“Affiliate” or “You”) in the SureGuard Affiliate Program (“Program”). By participating in the Program, you agree to comply with the following Terms:

1. Trademark Policy

Affiliates are strictly prohibited from bidding on any trademarked terms or variations of the SureGuard brand name in any pay-per-click (PPC) campaigns, including but not limited to search engines like Google, Bing, and Yahoo. This includes bidding on terms that are identical or confusingly similar to the brand name, as well as using the brand name in display URLs, ad copy, or any form of search engine advertising.

2. TM+ Bidding

Affiliates are prohibited from bidding on TM+ keywords, which include the brand’s trademarks (SureGuard and SureGuard Mattress Protectors) along with additional keywords (e.g., “SureGuard Coupon” or “SureGuard Discount”), without prior written approval from the brand. Any violation of this policy will result in the immediate suspension of the affiliate account.

3. Content Guidelines

Affiliates must not promote the SureGuard brand in any way that includes inappropriate, offensive, or unlawful content. This includes but is not limited to:

  • Content that is sexually explicit, violent, or promotes discrimination.
  • Content that promotes illegal activities.
  • Content that is misleading, false, or engages in deceptive marketing practices.

4. Compliance with FTC Guidelines

Affiliates must comply with all applicable advertising guidelines, including FTC endorsement regulations. All promotional content must include clear and conspicuous disclosure that the affiliate may receive a commission for sales generated through their links.

5. Cookie Stuffing and Link Cloaking

Affiliates may not engage in cookie stuffing, link cloaking, or any other deceptive tactics to artificially inflate affiliate commissions. Any detected manipulation will result in immediate termination from the program and forfeiture of unpaid commissions.

6. Social Media and Email Marketing

Affiliates are allowed to promote the SureGuard brand via social media and email marketing, provided that they comply with all applicable laws, including CAN-SPAM and GDPR. However, they may not represent themselves as the brand or mislead users about their relationship with the brand.

7. Brand Representation

Affiliates must not impersonate the SureGuard brand in any way, including the use of brand logos, fonts, or colors in a way that could confuse customers into thinking they are interacting directly with the brand.

8. Prohibited Traffic

Affiliates must not engage in or promote:

  • Any form of spam (e.g., email, comments, or forum posts).
  • Fraudulent traffic sources, including bot traffic or incentivized clicks.

9. Commissions & Payouts

Each affiliate referral link has a 30-day cookie duration. All purchases by a customer within 30 days of visiting the site and being tracked via your referral link will be attributed to you. The most recent referral link visited and tracked before the purchase is attributed the sale.

The standard commission rate is 15% of net sales (gross sales less refunds). Top performing affiliates may be offered a higher commission rate, at the brand’s discretion.

Commissions will be paid based on valid attributed sales, and any sales deemed fraudulent or resulting from violation of these terms will be deducted from commissions.

A commission is deemed to be earned 45 days after the date of attributed sale. This is to take into account the 30-day Refund Policy and the repayment of any refunds.

Commissions earned will be paid out monthly in US Dollars. The minimum balance to receive a payout is $100 ($500 for foreign wire transfers).

10. Right to Terminate

SureGuard reserves the right to terminate any affiliate at any time if they are found in violation of these terms or engaging in behavior that is detrimental to the brand’s reputation or business.

11. Governing Law

Your participation in the SureGuard Affiliate Program and any dispute arising out of such participation in the program is subject to the laws of the United States.

Changes to These Terms

We may update these Terms from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Terms on the Site, update the “Last updated”, and take any other steps required by law.
